1. Acceptance of Terms

By accessing, downloading, or using the Rythuri mobile application, website, or services (collectively, the "Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions ("Terms"). If you disagree with any part of these Terms, you may not access or use the Service.

These Terms constitute a legally binding agreement between you and Rythuri. We reserve the right to modify these Terms at any time, and your continued use constitutes acceptance of those changes.

2. Service Description

Rythuri provides an online platform for ordering fresh vegetables, fruits, and household groceries for delivery in Machilipatnam and surrounding areas. Our Service connects users with our delivery network to facilitate the delivery of products from our curated inventory.

Service Availability: We strive to provide continuous service but do not guarantee uninterrupted access. Service may be temporarily unavailable for maintenance, technical issues, or reasons beyond our control.

3. User Accounts

3.1 Account Registration

To use our Service, you must register an account using your mobile number for OTP-based verification. You agree to provide accurate, current, and complete information during registration and to update such information to maintain its accuracy.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account and mobile device. You agree to (a) notify us immediately of any unauthorized use of your account or any other security breach, and (b) ensure that you exit from your account at the end of each session.

3.3 Account Deletion

You may delete your account at any time through the app settings or by visiting our account deletion page. Account deletion is subject to our data retention policies as outlined in our Privacy Policy.

4. Orders and Payments

4.1 Order Placement

All orders are subject to product availability. We reserve the right to limit quantities, refuse service, terminate accounts, and cancel orders at our sole discretion, including without limitation, if we believe that user conduct violates applicable law or is harmful to our interests.

4.2 Pricing and Taxes

All prices are in Indian Rupees (₹) and include applicable taxes unless stated otherwise. Prices are subject to change without notice. The price charged for a product will be the price advertised on the Service at the time the order is placed.

4.3 Payment Methods

We accept various payment methods including UPI, credit/debit cards, net banking, and cash on delivery (where available). Payment processing is handled by secure third-party providers. By providing a payment method, you represent that you are authorized to use the payment method.

4.4 Billing and Payment Issues

In the event of payment issues, we reserve the right to cancel your order. For payment disputes, please contact our customer support within 7 days of the transaction.

5. Delivery Services

We strive to deliver orders within the estimated timeframes communicated during checkout. However, delivery times may vary due to factors beyond our control, including but not limited to traffic, weather conditions, product availability, and delivery address accuracy.

Delivery Areas: Our services are currently available in Machilipatnam and surrounding areas. Service availability is subject to change without notice.

Delivery Acceptance: You are responsible for ensuring someone is available at the delivery address to accept the order. If delivery cannot be completed due to your unavailability, additional delivery charges may apply for re-delivery.

6. Product Quality and Freshness

We take utmost care in selecting and handling fresh produce. However, as natural products, there may be variations in size, color, appearance, and freshness that are characteristic of agricultural products and beyond our control.

Quality Assurance: While we maintain high quality standards, the condition of perishable goods may vary. We follow best practices in storage and handling to ensure product quality.

8. Prohibited Activities

You agree not to engage in any of the following prohibited activities:

• Using the Service for any illegal purpose or in violation of any local, state, national, or international law
• Harassing, abusing, or harming another person or entity
• Submitting false or misleading information
• Interfering with or attempting to interfere with the proper working of the Service
• Bypassing any measures we may use to prevent or restrict access to the Service
• Attempting to gain unauthorized access to any portion of the Service, other accounts, or computer systems
• Using any engine, software, tool, agent or other device to navigate or search the Service
• Attempting to decipher, decompile, disassemble, or reverse engineer any of the software used in the Service

9. Intellectual Property

The Service and its original content, features, functionality, logos, trademarks, and graphics are owned by Rythuri and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Service without our express written permission.

10. User Content and Communications

By submitting any content (including feedback, reviews, or communications) through our Service, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and display such content for the purpose of operating and improving our Service.

You represent that you own or have the necessary rights to the content you submit and that such content does not violate the rights of any third party.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

RYTHURI DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL RYTHURI, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE
• ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE
• ANY CONTENT OBTAINED FROM THE SERVICE
• UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT

Note on Perishable Goods: While we take utmost care in quality control and handling, natural products may have variations in appearance, size, color, and freshness that are characteristic of agricultural products and beyond our control. We are not liable for such natural variations.

13. Indemnification

You agree to defend, indemnify, and hold harmless Rythuri and its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.

14. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

Upon termination, your right to use the Service will cease immediately. If you wish to terminate your account, you may simply discontinue using the Service or request account deletion.

15. Governing Law and Dispute Resolution

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions.

Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or invalidity thereof, shall be settled through mutual negotiations in good faith. If the dispute cannot be resolved through negotiations, it shall be subject to the exclusive jurisdiction of the courts in Machilipatnam, Andhra Pradesh, India.

16. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. The invalid or unenforceable provision shall be deemed modified to the minimum extent necessary to make it valid and enforceable.

17. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
